A motorcyclist who was involved in a
collision with a youngster allegedly playing chicken, is seeking
compensation from the CICA - 1st January 2007
The young pedestrian was killed as he
attempted to run in front of the motorcycle whilst playing a
game. He misjudged the speed of the vehicle and was struck with
some force.
The motorcyclist quite understandably wishes
to seek road accident
compensation. He motorist was cleared of any blame but
suffered serious injuries including a punctured lung, broken
ribs and a shoulder injury.
His solicitors have decided to attempt
claiming damages from the CICA who deal with compensation for
victims of violent crime.
They argue that the young pedestrian was
effectively committing a crime by endangering the lives of other
road users as a result of his alleged actions.
If the CICA agree to compensate the motorist
this will be a unique and unprecedented decision.
